When Can I Be Charged With Trespassing to Hunt?

State agencies have designated certain parts of Colorado for recreational use and allow hunters to kill animals while on public land. These include State Parks, State Trust Lands, and State Wildlife Areas. There are certain requirements to hunt in each area, but all of them will require hunters to have the proper licensing. So long as you are properly licensed, have permission from landowners or state agencies, and abide by local hours, you can hunt on these lands. Some areas do require reservations, however, and you should always check with the CPW if you are unsure about where you can hunt. Failing to follow proper licensing procedures or entering state land illegally can result in a trespassing violation.

Where Can I Legally Hunt?

The majority of trespassing to hunt violations occur on private land. Colorado homeowners and property owners can allow hunters to enter their private land to hunt, but hunters must have written permission first. State Trust Lands are also considered private land in certain areas, and hunters must obtain permission before they can enter and hunt any wildlife. If a hunter illegally enters someone else’s property to hunt game, or follows game onto someone else’s property, then they can be charged with trespassing to hunt under CPW § 33-6-116.

Consequences of a Wildlife Violation

CPW § 33-6-116 makes it a misdemeanor for a hunter to illegally enter private property to hunt wildlife. Upon conviction, a hunter can be charged a $250 fine and 20 license suspension points, which is grounds for a license to be suspended for at least one year. This charge only applies to entering private property with the intent to hunt, and defendants can still face additional charges if they are not properly licensed, kill wildlife illegally, or do not properly dispose of a carcass.
